Terms and Conditions

Article 1. Relevance

1.1 These General Terms and Conditions of Sale (hereinafter: Conditions) apply to all offers, orders and agreements of kroeshaar.com to the exclusion of any other general terms and conditions.

1.2 By placing an order with kroeshaar.com you agree to these Terms.

1.3 These Terms and Conditions can only be deviated from in writing or by email. In that case, all other provisions of these Terms will remain in effect.

1.4 All rights and claims stipulated in these Conditions and in any further agreements for the benefit of kroeshaar.com also apply to any intermediaries and other third parties engaged by kroeshaar.com.

Article 2. Offers / agreements

2.1 All offers from kroeshaar.com are without obligation. kroeshaar.com has the right to change prices, in particular when this is necessary on the basis of (legal) regulations. See also article 3.6.

2.2 An agreement is only concluded when kroeshaar.com has accepted your order. kroeshaar.com has the right to refuse orders with reasons or to attach special conditions to the delivery. If your order is not accepted, you will be notified within ten (10) working days. 

Article 3. Prices and payments

3.1 The prices stated for the items and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless otherwise stated or agreed by email.

3.2 For orders with a delivery address in the Netherlands or abroad, you must pay the amount due (without discount or compensation) within fourteen (14) days after the invoice date, unless otherwise agreed by email.

3.3 You can pay by using one of the payment methods offered during the ordering process: via Internet banking, Paypal or Credit card. Your order may be subject to further (payment/order) conditions. When paying by bank or giro, the date of payment is the date of crediting the giro or bank account of kroeshaar.com.

3.4 If you do not pay in full on time, kroeshaar.com has the right to suspend or dissolve the agreement in question and any related agreements.

3.5 If the prices of the offered items and services increase in the period between the time you order and the execution of the order by kroeshaar.com, you have the right to cancel the order or to dissolve the agreement within ten (10) days. after notification of the price increase by kroeshaar.com.

Article 4. Delivery

4.1 The delivery times stated on the website are indicative. You will receive your order expeditiously. That is usually within 10 working days, no later than 30, unless stated otherwise by kroeshaar.com. In the latter case, you will be notified in good time.

4.2 Until the moment of shipment you have the right to dissolve the agreement free of charge. After shipment you are not entitled to compensation.

4.3 If a product is not available, you will be notified. If there is no response, your order will be sent at most one week later. You will also be given the option to opt for a voucher instead of any delay.

4.4 In the rare case that a product is missing, you should immediately report this via email to the webshop. Products cannot be sent with the current prices, but you are entitled to a credit voucher worth the missing product, if it appears that the webshop has failed.

Article 5. Retention of title

5.1 Ownership of delivered items only transfers when you have paid the amount due. The risk with regard to the articles is already transferred to you at the moment of delivery.

Article 6. Intellectual and industrial property rights

6.1 You must fully and unconditionally respect all intellectual and industrial property rights that rest on the items delivered by kroeshaar.com.

6.2 kroeshaar.com does not guarantee that the articles delivered to you do not infringe any (unwritten) intellectual and/or industrial property rights of third parties.

Article 7. Complaints and liability

7.1 Check the delivered items immediately upon receipt. You must report any defects to kroeshaar.com within 3 days of receipt by email and with reasons.

7.2 If it is shown that an article does not comply with the agreement, kroeshaar.com offers a voucher for the value of the article.

7.3 Every sale is final. It is not possible to exchange products. 

Article 8. Orders / communication

8.1 kroeshaar.com is not liable for misunderstanding, damage, delays or improper transmission of orders and communications as a result of the use of the internet or other means of communication between you and kroeshaar.com, or between kroeshaar.com and third parties, unless there is intent or gross negligence on the part of kroeshaar.com.

Article 9. Returning an order

Unfortunately, for reasons of health protection and hygiene, the hair products cannot be returned or exchanged. If the item is damaged, you can submit a complaint by email within 7 days with proof of the damage. In case of total damage, new products will be sent free of charge. In case of limited or minimal damage, you will receive a voucher.

Article 10. Miscellaneous

10.1 You cannot derive any rights from the fact that kroeshaar.com may apply these Conditions flexibly.

10.2 If one or more of the provisions of these Terms or any other agreement with kroeshaar.com should conflict with any applicable legal provision, the relevant provision shall lapse and be replaced by a new, comparable provision to be determined by kroeshaar.com.

10.3 kroeshaar.com may use third parties for the execution of your order(s).

10.4 Without prejudice to the other rights accruing to kroeshaar.com, kroeshaar.com has the right in case of force majeure to suspend the execution of your order, or to dissolve the agreement without judicial intervention by communicating this to you by email.

Article 11. Applicable law and competent court

11.1 These Terms and Conditions and all rights, obligations, offers, orders and agreements to which these Terms and Conditions apply are exclusively governed by Dutch law.

11.2 All disputes between the parties will be submitted exclusively to the competent court in the Netherlands.
